2. Scope and Acceptance of these Terms

These General Terms and Conditions (hereinafter: "Terms") apply to purchase contracts concluded through the agau999.com website (hereinafter: "Webshop"), operated by Marvena Mint Kft. (hereinafter: "Service Provider"). By purchasing through the Webshop, the Customer accepts these Terms.

3. Language and Form of the Contract

Contracts concluded through the Webshop are in Hungarian. The resulting contract qualifies as a contract in writing and is stored electronically by the Service Provider.

4. Registration and the Ordering Process

The Customer may place an order without registration, as a guest. The order is placed by adding the product to the cart, providing the required details (billing and shipping address, contact information), selecting the payment and shipping method, and finalizing the order (by clicking the order button, which carries a payment obligation). After the order is submitted, the Service Provider sends a confirmation e-mail. The contract is formed when the Customer receives this confirmation.

The Service Provider is not liable for shipping or other issues resulting from incorrect or inaccurate data provided by the Customer.

By finalizing the order (clicking the order button that carries a payment obligation), a binding purchase contract is formed between the Customer and the Service Provider, which entails a payment obligation on the Customer's part. Given that the price of investment gold and silver products is subject to continuous fluctuation of international market prices, the price stated in the confirmation only binds the Service Provider if the Customer pays the purchase price, in case of bank transfer, within 24 hours of the confirmation. If the payment deadline passes without payment, the Service Provider is entitled to unilaterally withdraw from the order — without any further obligation — and to resell the product at the then-current market price. Delayed payment does not release the Customer from the obligation to pay as long as the Service Provider has not exercised the above right of withdrawal; in that case the Service Provider is entitled to demand payment and, if unsuccessful, to enforce the claim through the channels provided by law (payment reminder, or if necessary payment order or court proceedings).

5. Products and Prices

Prices shown in the Webshop are in Hungarian forint (HUF) and include VAT as legally applicable (part of the investment-grade precious metals offered may fall under the VAT exemption applicable under the relevant legislation).

The price of the investment gold and silver products follows the continuous fluctuation of the international market price (spot price) of precious metals, so the Service Provider is entitled to adjust prices in line with market price movements without prior notice. The price displayed in the Webshop at the moment the order is finalized (clicking the order button that carries a payment obligation) is always the price that applies to the Customer. The Service Provider does not subsequently unilaterally change the price of a confirmed order.

If a manifestly incorrect price is displayed in the Webshop (e.g. due to a system error), the Service Provider is not obliged to deliver the product at the incorrect price; it will inform the Customer without delay and offer the option to order at the correct price or to cancel the order free of charge.

6. Payment Methods

The following payment methods are available in the Webshop:

  • cash payment upon personal pick-up;
  • advance payment by bank transfer;
  • cash on delivery, for orders up to HUF 100,000.

Bank account details for bank transfer:

Account-holding bank: OTP Bank Nyrt. (registered seat: 1051 Budapest, Nádor utca 16., Hungary)
HUF account number: 11744003-24453110
EUR IBAN: HU78 1176 3440 4886 8886 0000 0000
SWIFT/BIC: OTPVHUHB

As a precious metals dealer, the Service Provider is subject to Act LIII of 2017 on the Prevention and Combating of Money Laundering and Terrorist Financing (the "AML Act"). Accordingly, for transactions reaching HUF 300,000 the Service Provider records the Customer's identification data; for cash transactions reaching or exceeding HUF 3,000,000 it carries out full customer due diligence; and for transactions above HUF 4,000,000 it may request proof of the source of funds and a declaration of politically exposed person (PEP) status from the Customer. Details of the related data processing are set out in the Webshop's Privacy Notice.

7. Shipping and Delivery

The Service Provider ships ordered products via MPL (Magyar Posta Logisztika) and FedEx courier services, as insured parcel shipments. The shipping fee is tiered depending on the order value:

  • up to HUF 500,000 order value: HUF 10,000 shipping fee;
  • between HUF 500,001–1,000,000 order value: HUF 15,000 shipping fee;
  • between HUF 1,000,001–5,000,000 order value: HUF 40,000 shipping fee.

For orders above HUF 5,000,000, the shipping fee and security conditions for delivery are agreed individually between the Service Provider and the Customer. The Service Provider also offers personal pick-up at its registered seat, by prior appointment.

8. Right of Withdrawal

Under Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses, a Customer qualifying as a consumer is, as a general rule, entitled to a 14-day right of withdrawal without justification.

The Service Provider informs Customers that, pursuant to Section 29(1)(b) of Government Decree 45/2014 (II.26.), the consumer may not exercise the right of withdrawal for products whose price depends on fluctuations in the financial market which the Service Provider cannot influence and which may occur within the 14-day withdrawal period. Since the price of the investment gold and silver products sold in the Webshop directly depends on changes in the international market price of precious metals, the right of withdrawal cannot be exercised for these products under the law.

This exception to the right of withdrawal does not affect the Customer's warranty and guarantee rights in case of defective performance.

9. Warranty

The Service Provider is liable for warranty (kellékszavatosság) in respect of the products it sells, in accordance with Act V of 2013 on the Civil Code and the applicable consumer protection legislation. The Customer may assert a warranty claim within one year (two years for consumers) from the date of performance. The Service Provider provides detailed information on the warranty claim procedure through customer service.

10. Complaint Handling

The Customer may report complaints regarding the product or the Service Provider's activity at info@agau999.com or by phone at +36 70 556 3480. The Service Provider investigates and responds to received complaints within the statutory deadline. If the complaint is not resolved directly with the Service Provider, the Customer may turn to the conciliation board competent for their place of residence, or to the consumer protection authority.

11. Data Processing

The Service Provider processes Customers' personal data in accordance with applicable law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR). Detailed rules are set out in the Webshop's separate Privacy Notice, available at agau999.com/oldal/adatkezelesi-tajekoztato.

12. Intellectual Property

All content appearing on the Webshop (texts, images, graphic elements, trademarks) is the intellectual property of the Service Provider and may not be used without the Service Provider's prior written consent.

13. Force Majeure

The Service Provider is not liable for any hindrance to the performance of the contract arising from a cause beyond its reasonable control that it could not reasonably avert (force majeure), including in particular difficulties in the availability or sourcing of precious metals on the market.

14. Final Provisions

Matters not regulated in these Terms are governed by Hungarian law, in particular Act V of 2013 on the Civil Code and the applicable consumer protection legislation. The Service Provider reserves the right to unilaterally amend these Terms; any amendment applies to orders placed after publication on the Webshop.

These Terms were last updated in September 2026.
